MAIÈ Retail operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). MAIÈ Retail is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services, or otherwise communicate with us, in accordance with the Protection of Personal Information Act, No. 4 of 2013 ("POPIA"). Under POPIA, MAIÈ Retail is the "Responsible Party" for the personal information described in this Policy. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Financial information, including payment card details, transaction details, form of payment, and payment confirmation. Full card details are processed directly by our payment gateway provider (Peach Payments and/or Yoco) and are not stored on our own systems.

Transaction information, including items you view, add to your cart or wishlist, purchase, return, exchange, or cancel, and your past transactions.

Communications with us, including information contained in customer support inquiries.

Marketing and advertising: including sending marketing communications by email, SMS, or post, and showing you relevant advertisements, where you have consented to this or where we otherwise have a lawful basis to do so under POPIA. You may opt out of marketing communications at any time.

Security and fraud prevention: including authenticating your account, securing payments, and detecting or investigating fraudulent or unlawful activity.

Communicating with you: including providing customer support and maintaining our relationship with you.

Legal compliance: including complying with applicable law, valid legal process, or requests from regulators or law enforcement, and enforcing our terms and policies.

Third parties you direct us to share information with, such as for delivery of your order.

Relationship with Shopify

The Services are hosted by Shopify, which processes personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit through the Services may be transmitted to and processed by Shopify and other service providers, some of whom may be located outside South Africa. To the extent Shopify processes your personal information for its own purposes (such as enhanced features informed by activity across the wider Shopify merchant network), Shopify acts as a separate Responsible Party for that processing and is responsible for responding to related requests. In accordance with POPIA, we do not knowingly collect personal information from a child (a person under the age of 18) without the consent of a competent person (such as a parent or legal guardian), except where such processing is permitted without consent under POPIA. Security and Retention of Your Information

We implement reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, and unlawful processing, as required under POPIA. However, no security measures are perfect, and we cannot guarantee absolute security, including for information transmitted to us. We recommend avoiding unsecure channels for sensitive or confidential communications.

We retain personal information only for as long as necessary to fulfil the purposes described in this Policy, including maintaining your account, providing the Services, complying with legal obligations, and resolving disputes, after which it is deleted or de-identified in accordance with POPIA.

  • Right to Access: to request confirmation of and access to the personal information we hold about you.

Right to Correction: to request that we correct or update inaccurate, incomplete, or outdated personal information.

Right to Deletion: to request that we delete or destroy personal information we hold about you where we are no longer authorised to retain it.

Right to Object: to object to the processing of your personal information, including for direct marketing purposes, on reasonable grounds.

Right Regarding Automated Decision-Making: not to be subject to a decision based solely on automated processing, including profiling, which affects you in a significant way, except in circumstances permitted by POPIA.

Managing Communication Preferences: you may opt out of promotional emails at any time using the unsubscribe link provided; you may still receive non-promotional communications, such as those relating to your account or orders.

You may exercise these rights by contacting us using the details below. We may need to verify your identity before processing your request, and we will respond within the timeframes required under POPIA. You may also authorise an agent to submit a request on your behalf, subject to proof of authorisation.

We will not discriminate against you for exercising any of these rights.

International Transfers

Where we do so, we ensure, in accordance with section 72 of POPIA, that: the recipient is subject to a law, binding corporate rules, or binding agreement that provides an adequate level of protection substantially similar to POPIA; or you have consented to the transfer; or the transfer is necessary to perform our contract with you or to implement pre-contractual measures taken at your request.
